DOGOOD SOUND (“DOGOOD SOUND" or "us," "our," "we") recognizes and respects the importance of maintaining the privacy of its users and, as a result, has established this Privacy Policy. The use of the Site and/or the System is subject to the Terms and this Privacy Policy.

Information We Collect

When you visit the Site, we automatically collect certain information about your device, your interaction with the Site, and needed information to process your purchases. We may also collect additional information if you contact us for customer support. In order to use our Site and/or Services, you will be required to provide us with certain Personal Information (as defined below), either through the creation of an account or by logging in through an approved third party login service. We may also collect additional Personal Information when you make use of the Site, request information from us, sign up for newsletters or our email lists, complete online forms, or contact us for any other reason. "Personal Information" (Device Information and Order Information) means information that can be directly associated with a specific person such as a name, telephone number, e-mail address, billing address, shipping address, payment information (including credit card numbers), or information about activities directly linked to a person, also version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site. In the event you access to the Site through your social media account or any other third party login, any information available through such social media and/or third party login account.

It is your voluntary decision whether to provide us with any such Personal Information, but not providing such information may cause us not to be able to register you to the Site and/or provide you with Products/Services.

DOGOOD SOUND and any of our trusted third-party subcontractors and service providers may use the information we collect from and about you for any of the following purposes: (1) provide you with our services and information or advertising relating to our products or services; (2) fulfil any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations, (3) respond to your inquiries or requests, contact, and communicate with you; (4) develop new services and conduct analyses to improve our current content, products, and services; (5) review the usage and operations of our Site and Services; (6) use your data in an aggregated, non-specific format for analytical purposes (as detailed below); (7) prevent fraud, protect the security of our Site and Services, and address any problems with the Site and/or Services; and (8) to maintain our records and protect our legal rights.

Statistical Information

By analyzing all information we receive, including all information concerning users, we may compile statistical information across a variety of platforms and users (“Statistical Information”). Statistical Information helps us understand trends and customer-needs so that new products and services can be considered and so existing products and services can be tailored to customer desires. Statistical Information is anonymous and aggregated and we will not link Statistical Information to any Personal Information. We may share such Statistical Information with our partners, without restriction, on commercial terms that we can determine in our sole discretion. We may provide information that we receive to Google Analytics and/or other Tools (as defined and more fully detailed below) in order to receive an analysis of the use of our Site and Services.

Analytics

We may use certain tools, including, but not limited to, "Google Analytics" to analyze the Statistical Information ("Tools"). The Tools collect only the IP address assigned to you on the date you visit this Site, rather than your name or other identifying information. We do not combine the information collected through the use of the Tools with Personal Information. We may use the information we receive from the Tools to improve the Site. Disclosure of Information

Except as expressly set forth herein, we will not share your Personal Information with third parties without your explicit permission, except when required by law, regulation, subpoena, court order or other law enforcement related issues, as specified below.

We may share your information, including Personal Information, as follows:

Business Partners, Service Providers, Affiliates, and Subcontractors
We may disclose information, including Personal Information, we collect from and/or about you to our trusted service providers, business partners, affiliates, and subcontractors, who may use such information to: (1) help us provide you with Services; and (2) aid in their understanding of how users are using our Site and Services.

Law Enforcement related disclosure

We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity, behaviour or digital content of any user suspected to have engaged in illegal or infringing behaviour. We allow you to use our Site and Services in connection with third party services, sites, and/or applications. If you use our Site and/or Services with or through such third parties, we may receive information about you from those third parties. Please note that when you use third parties outside of our Site and/or Services, their own terms and privacy policies will govern your use of those services.

Data Retention

We retain information as necessary for the purposes set forth above. We may delete information from our systems, without notice to you, once we deem it is no longer necessary for the purposes set forth above.

When you place an order through the Site, we retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see the ‘Your rights’ section below.

Do not track

Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

Changes

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

How we Protect Information

We make efforts to follow generally accepted industry standards to protect the Personal Information submitted to and collected by us, both during transmission and once we receive of such information. However, no method of transmission over the Internet, or method of electronic storage is 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

How to Limit Our Use of Certain Information

You have a right to know what information we hold about you and, in some cases, to have such information communicated to you. You may also ask for our confirmation as to whether or not we process Personal Information concerning you.

Subject to the limitations in applicable law, you are entitled to request that we update, correct or delete inaccurate or outdated information, and have us suspend the use of Personal information whose accuracy you contest while we verify the status of that data.

Subject to the limitations in applicable law, you may also be entitled to obtain from us the Personal Information you provided us (excluding data we obtained from other sources) in a structured, commonly-used and machine-readable format, and may have the right to transmit that data to another party.

If you wish to exercise these rights, please contact us and let us know that you wish to exercise your right of access and specify which information you would like to receive. We reserve the right to ask for reasonable evidence to verify your identity before we provide you with any information, and may, subject to applicable law, charge a fee for exercising this right of access. Where we are not able to provide you with information that you have asked for, we will endeavor to explain the reasoning for this.

We will delete information provided to us by a user within a reasonable time from the receipt of a written (including via email) request by such user to delete such collected information, provided however that we may retain a copy of certain information for audit and record-keeping purposes and in order to contact you in the future, all as permissible by law. We cannot restore information once it has been deleted. Please note that to ensure that we do not collect any further information about you, you should delete your DOGOOD SOUND account.

Your request to limit the use of or delete your Personal Information will be processed as soon as reasonably possible.

Automatic Decision-Making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days. 

Your Rights

If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information below.

Additionally, if you are a European resident we note that we are processing your information in order to fulfil contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the ‘Right to Know’), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. A cookie is a small piece of text that is sent to a visitor's browser. The browser provides this piece of text to the device of the originating visitor when this visitor returns. DOGOOD SOUND uses cookies to help personalize your DOGOOD SOUND experience. A “persistent” cookie may be used to help save your settings and customizations across site visits. Also, if you log in to DOGOOD SOUND, such a cookie will be used to recognize you as a valid user so you will not need to log in each time you use DOGOOD SOUND. Communications

We may process your Personal Information for certain internal marketing purposes. We may send you e-mails and/or other account messages about us or our Products and Services. By accepting this Privacy Policy and/or using the Site and/or Services, you affirmatively consent to receive such commercial messages. You may remove your Personal Information from our mailing list and stop receiving future communication from us by following the UNSUBSCRIBE link located at the bottom of each communication or by emailing us at info@dogoodsound.com. You will also be given the opportunity to unsubscribe from commercial messages in any such e-mail or message we send. Please note that we reserve the right to send you service-related communications, including service announcements and administrative messages, relating either to your account or to your transactions on the Site, without offering you the opportunity to opt-out of receiving them. Should you not wish to receive such communications you may cancel your account.

Children

The Site is not intended for individuals under the age of 18.

DOGOOD SOUND does not knowingly collect Personal Information from children under the age of thirteen (13). In the event you become aware that an individual under the age of thirteen (13) has enrolled without parental permission, please advise us immediately.
